Luane's body was found in a motel. A cellphone left in the room identified her killer as a pastor, who, according to the prosecutor, killed her after he discovered she was trans.

A homicide motivated by a trivial argument and committed through asphyxiation. Thus, prosecutor Fabio Perez Fernandez, who works before the Jury Court of Santos, on the coast of São Paulo, summarized the murder of Luane Costa da Silva, a trans woman, and denounced the accused of committing it: engineer Antonio Lima dos Santos Neto, 45 years old, who said during questioning to the police that he was also a pastor of a church.

The crime took place on the evening of the 22nd in room number 10 of the Danúbio Hotel, located on Rua Rangel Pestana, in Vila Mathias. The engineer arrived at the scene by car with the victim at 8:00 p.m., but he was the only one who walked to the reception, where he paid R$60.00 for a one-hour stay. He then walked to the stairs, where Luane was waiting for him, and they both headed to the suite. About half an hour later, Antonio left alone in the vehicle.

The formal accusation by the representative of the Public Prosecutor's Office (MP) was filed on Wednesday (31). In his initial accusation, the prosecutor states that “the accused and the victim were going to have a sexual encounter, at which point Antônio realized that the victim was a transsexual woman and, therefore, gave up on the sexual encounter. Given the cancellation of the sexual encounter, the accused and the victim had a trivial argument”.

Because of this disagreement, according to Perez, “Antônio squeezed Luane’s neck until she died by asphyxiation.” Futile motive and asphyxiation are qualifiers of homicide, which make it a heinous crime and increase its sentence to 12 to 30 years. Without the qualifiers, homicide would be considered simple and punishable by six to 20 years in prison, without receiving the harsher treatment due to the heinousness.
